Terms of Service

For the use of the Brain Clarity app and Brain Clarity Pro subscription

1. Scope and Contracting Parties

These Terms of Service ("Terms") govern your use of the Brain Clarity mobile application (the "App") and the paid subscription Brain Clarity Pro (the "Subscription").

These Terms apply to consumers within the meaning of §13 BGB (German Civil Code). Conflicting terms of users are not recognised.

2. Conclusion of Contract

The Brain Clarity App is distributed through the Apple App Store and Google Play Store. The purchase contract for a Subscription is concluded directly with Apple Inc. (for App Store purchases) or Google Ireland Limited (for Google Play purchases) as "Merchant of Record", not with snap GmbH directly. Apple and Google act as resellers in their own name.

snap GmbH provides the App content and the Pro feature set; Apple or Google handle payment, receipts, and any refunds.

3. Brain Clarity Pro — Scope of Service

An active Brain Clarity Pro Subscription unlocks the following additional features:

• Difficulty levels 4 and 5 in all eight games
• Unlimited games per day (Free version: 3 games / day)
• Full Brain Profile across all seven cognitive domains
• Cognitive Index up to 100 (Free version: capped at 65)
• Mastery badges across all levels
• Unlimited historical trends
• Personalised daily training plan
• Access to weekly and all-time leaderboards

snap GmbH reserves the right to further develop, supplement, or replace individual features with equivalent ones, without this constituting grounds for termination, as long as the core scope is preserved.

4. Prices and Payment

Brain Clarity Pro is offered at the following prices (as of May 2026):

• Monthly plan: $7.99 / 7,99 € per month (incl. statutory VAT)
• Annual plan: $39.99 / 39,99 € per year (incl. statutory VAT), equivalent to ~$3.33 / 3,33 € per month

Payment is processed exclusively through the payment method stored in your App Store or Google Play account. snap GmbH does not receive payment details directly.

5. Free Trial (Annual Plan Only)

The annual plan includes a 7-day free trial for new subscribers. During the trial, no payment is charged.

Important: The trial automatically converts to the paid annual plan unless cancelled at least 24 hours before the trial ends. Cancellation is not handled by snap GmbH but directly through your Apple ID or Google Account settings (see Section 7).

The trial is available only once per Apple ID and per Google Account. If you have already used the trial, you will be charged immediately upon re-subscribing.

6. Term and Automatic Renewal

The monthly plan runs for one month and renews automatically for another month unless cancelled. The annual plan runs for one year and renews accordingly.

Apple and Google notify users of upcoming renewals in accordance with their own policies.

7. Cancellation

Cancellation of the Subscription is performed directly in the store settings:

• iOS / iPadOS: Settings → [Your Name] → Subscriptions → Brain Clarity Pro → Cancel Subscription
• Android: Google Play Store → Profile picture → Payments & subscriptions → Subscriptions → Brain Clarity Pro → Cancel subscription

After cancellation, your Pro status remains active until the end of the current billing period — no early refund is issued.

Confirmation of cancellation is sent by Apple or Google to your registered email address.

8. Right of Withdrawal

Consumers generally have a 14-day right of withdrawal for contracts on digital content (§§ 312, 355 BGB).

Expiry of the right of withdrawal: Under § 356 (5) BGB, the right of withdrawal expires prematurely once snap GmbH has begun performing the contract, provided that you have

• explicitly agreed that performance of the contract should begin before the expiry of the withdrawal period, and
• confirmed your awareness that, by giving this consent, you lose your right of withdrawal once performance begins.

This consent is explicitly requested when activating the Subscription. Since Brain Clarity Pro content is available immediately upon purchase, you lose your right of withdrawal as soon as you activate the Subscription.

Refunds after activation can only be requested through Apple's or Google's refund processes — see Support & Help.

9. Refunds

Refunds are handled exclusively through Apple (App Store) or Google (Google Play), who act as contracting parties for the payment transaction. snap GmbH has no technical access to store transactions.

A successful refund automatically ends Pro status (via the webhook received from RevenueCat). Streaks, scores, and achievements you have already earned are preserved — only Pro access is removed.

10. User Obligations and Conduct

Users undertake to:

• use the App and Subscription exclusively for personal, non-commercial purposes,
• refrain from manipulating the App, its data, or the leaderboards,
• not create multiple accounts to distort leaderboards,
• keep their login credentials secure and not share them with third parties.

In the case of serious breaches, snap DISCOVERY AG (for the App) or snap GmbH (for the Subscription) may, after prior warning, suspend access or terminate the contract extraordinarily.

11. Limitation of Liability

Brain Clarity is not a medical device and not a diagnostic tool. The App makes no medical or therapeutic claims about cognitive abilities or health. It cannot replace medical advice.

We are liable for damages only to the extent that they are based on a breach of essential contractual obligations ("cardinal obligations") or on gross negligence or intent. In the case of simple negligence, liability is limited to the foreseeable damage typical of the contract.

Liability under the Product Liability Act, for injury to life, body, or health, and on the basis of guarantees, remains unaffected.

12. Data Protection

The processing of personal data is governed by the separate Privacy Policy, which is part of these Terms.

13. Changes to These Terms

snap GmbH reserves the right to adapt these Terms to the extent that this is necessary due to changes in legal regulations, jurisprudence, or to close regulatory gaps. Changes will be communicated to users at least 30 days before they take effect, by email or as an in-app message.

If users do not object within 30 days of notification of the change, the amended version is deemed accepted.

14. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as they are not deprived of mandatory protective provisions of the state in which they have their habitual residence.

The place of performance and exclusive place of jurisdiction for disputes with merchants, legal persons under public law, or special funds under public law is Bochum.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory regulation.
